Terms of Service

About this version: The current Staqq app lets you register, join our early-access list and learn about our forthcoming service. It does not currently provide any wallet, payment or electronic money service. You cannot add, hold, send, spend or withdraw money through the app in this version. Payment features will be introduced in a later release under separate, updated terms and through an FCA-authorised partner, and we will tell you before that happens.
1. About these terms and who we are
These Terms of Service ("Terms") form an agreement between you and Staqq Ltd ("Staqq", "we", "us", "our"), a company registered in England and Wales (Company No. 17336294), registered office Suite 7, 94 Chatsworth Road, Croydon, Surrey, CR0 1HB. By creating an account or using the Staqq app or website (the "Service"), you accept these Terms.
Regulatory status. The Service currently provides registration, early-access sign-up and information only. It does not provide any payment, electronic money ("e-money") or other regulated financial service, and Staqq Ltd is not carrying on any regulated activity through the Service in this version. Staqq Ltd is not authorised by the Financial Conduct Authority (FCA). When we introduce payment/e-money features, those regulated services will be provided by an FCA-authorised Electronic Money Institution partner under separate, updated terms, and we will make that clear to you at the time.
2. Eligibility
To use the Service you must be at least 18 years old, resident in the United Kingdom, have legal capacity to enter into these Terms, and not be subject to sanctions or otherwise prohibited from using the Service under applicable law. By using Staqq you confirm that you meet these requirements.
3. Your account
To use the Service you may open an account. You agree to provide accurate, current and complete information; keep your credentials secure and not share them; and tell us immediately if you suspect unauthorised access. We do not require identity verification (KYC) in this version, because no payment service is offered; identity verification will be introduced with the payment features in a future release.
4. What Staqq currently offers
In this version, the Service allows you to:
- Create an account and register your interest in Staqq.
- Join our early-access / waitlist so we can tell you when the full service launches.
- Read information about how Staqq will work.
What the Service does NOT do in this version: there is no wallet and no balance; you cannot add, hold, spend, send or withdraw money; and no electronic money is issued to you. Any references in our marketing to receiving, holding or spending digital change describe our forthcoming service, not features available in this version.
5. Acceptable use
You must not use the Service to break the law or any regulation; to defraud or impersonate; to open multiple accounts or misrepresent your identity; or to reverse-engineer, tamper with or disrupt the Service.
6. Intellectual property
The Staqq name, logos, software and content are owned by Staqq Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. No other rights are granted.
7. Our responsibility to you
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for loss or damage that is not foreseeable.
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any right you have under the Consumer Rights Act 2015 or other law that cannot be excluded or limited.
Because the Service does not hold or move money in this version, it does not give rise to payment-services or e-money liabilities. Those protections (including under the Payment Services Regulations 2017 and the Electronic Money Regulations 2011) will apply, where relevant, when payment features launch under the updated terms.
8. Suspension and termination
We may suspend or close your account where we reasonably suspect fraud or a breach of these Terms, or to protect you or the Service. You may close your account at any time via our account deletion page. As no money is held in this version, there is no balance to return on closure.
9. Changes to the Service and these Terms
We may change the Service or these Terms and will give reasonable notice of material changes through the app or by email. In particular, before we introduce payment/e-money features we will provide updated terms describing those regulated services, and — where the law requires it — the notice periods and protections that apply to them. If you do not agree to a change you may close your account before it takes effect.
10. Complaints
If something goes wrong, please contact us at info@staqq.co.uk so we can put it right. For concerns about your personal data you may also contact the Information Commissioner's Office (ico.org.uk). Access to the Financial Ombudsman Service will apply once you are using regulated payment services under the future updated terms.
11. Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Disputes will be dealt with by the courts of England and Wales. If you are a consumer, you may also bring proceedings in the courts of the part of the United Kingdom in which you live.
12. General
- Force majeure — we are not liable for failures caused by events beyond our reasonable control.
- Assignment — we may transfer these Terms to another entity with notice to you and without reducing your rights; you may not transfer yours without our consent.
- Third-party rights — no one other than you and Staqq has rights under these Terms.
- Severability — if any provision is found unenforceable, the rest continue in force.
- Entire agreement — these Terms and the Privacy Policy form the whole agreement between us. These Terms are provided in English.
